AN ORDINANCE AMENDING TOWN ORDINANCE NO.: 462, BEING, "AN ORDINANCE REGULATING THE CONSTRUCTION, ALTERATION, REPAIR, LOCATION AND USE OF BUILDINGS AND STRUCTURES IN THE TOWN OF CEDAR LAKE, INDIANA, INCORPORATING BY REFERENCE BUILDING RULES, CODES AND STANDARDS REQUIRED TO BE ENFORCED UNDER I.C. §36-7-2-9; PROVIDING FOR THE ISSUANCE OF PERMITS; PROVIDING PENALTIES FOR VIOLATIONS, AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH", AND REPEALING ALL TOWN CODE SECTIONS AND ORDINANCES, OR PARTS THEREOF, IN CONFLICT HEREWITH, AND ALL MATTERS RELATED THERETO.

WHEREAS, the Town Council of the Town of Cedar Lake, Lake County, Indiana (hereinafter "Town Council"), is the duly elected legislative body of the Town of Cedar Lake, with authority to adopt Ordinances in conformance with the substantive and procedural requirements of Indiana Law, as amended (hereinafter, the "600 Series"); and

WHEREAS, the Town Council has reviewed the present text provisions of the Town Zoning Code, and specifically Title XV, Chapter 150, Section 150.06, as amended from time to time, regarding Permits Required in the Town of Cedar Lake; and

WHEREAS, the Town Council has met in a duly noticed Public Meeting, in conformance with applicable law, to consider the advisability and necessity of amending provisions of the Town Code, Title XV, Chapter 150, Section 150.06, as amended from time to time, regarding Permits Required in the Town of Cedar Lake; and

WHEREAS, the Town Council has, at the conclusion of its Public Meeting review, determined that it is appropriate, advised, and in the best interests of the residents of the Town of Cedar Lake that the Town Code, Title XV, Chapter 150, Section 150.06, as amended from time to time, regarding Permits Required in the Town of Cedar Lake; and

WHEREAS, the Town Council, having reviewed these matters and proposed text amendments to the Town Code, Title XV, Chapter 150, Section 150.06, as amended from time to time, regarding Permits Required in the Town, now concurs that it is advisable, appropriate, and in the best interests of the residents and property owners of the Town of Cedar Lake that certain text provisions of the Town Code as amended from time to time, be amended and modified regarding Permits Required in the Town.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CEDAR LAKE, LAKE COUNTY, INDIANA, AS FOLLOWS:

SECTION ONE: That Section 150.06, entitled "PERMITS REQUIRED", of Title XV of the Town Code, as amended from time to time, be, and the same is hereby amended, to read and provide hereafter as provided on the attached amended Title XV, Section 150.06 provisions document, consisting of one (1) page, which is attached hereto as "Exhibit A", and which terms are, upon adoption, incorporated herein by reference.

SECTION TWO: That all existing Town Code Sections and Ordinances, or parts thereof, in conflict with the provisions of this Amendatory Ordinance, are hereby repealed, and declared to be null, void, and of no legal effect.

SECTION THREE: That if any section, clause, provision or portion of this Amendatory Ordinance shall be held to be invalid or unconstitutional by any Court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion of this Amendatory Ordinance.

SECTION FOUR: That this Amendatory Ordinance shall take effect, and be in full force and effect, from and after its passage and adoption by the Town Council of the Town of Cedar Lake, Lake County, Indiana, pursuant to applicable law.

Subject: Monastery Woods, Phase 3A — Final Plat Review #1 (CBBEL Project No. 060015.00017)

Dear Plan Commission Members:

As requested, Christopher B. Burke Engineering, LLC (CBBEL) staff have reviewed Final Plat drawings for Monastery Woods, Phase 3A. This phase consists of 44 residential lots. The drawings were provided by V3 Companies, Ltd. and were reviewed for compliance with the Town of Cedar Lake's (Town) Subdivision Ordinance (No. 498), Stormwater Ordinance (No. 1218), and associated standard engineering methods.

CBBEL received the following items to review:

The Plat appears to be in accordance with the Town's Subdivision Ordinance and it is our recommendation that it be approved. Please note that the Applicant is required to provide a certified check or money order payable to the Town in an amount equal to three (3%) percent of the cost of the improvements prior to Final Plat Approval to cover inspection fees. The amount is based on the engineer's estimate of probable cost for Phase 3A and is $49,354.19. The estimate of probable cost is attached.

The Developer has provided an estimate of probable cost for the public improvements associated with this project. CBBEL staff have reviewed that information in conjunction with the Monastery Woods, Phase 3A plans for the purpose of establishing the required Performance Letter of Credit for the platted portion of the subdivision. After review, the estimate of probable costs for Phase 3A is $1,645,139.80. CBBEL will eventually base Maintenance Letter of Credit values off this amount. Both CBBEL and Town staff have performed inspections of the public infrastructure that has already been installed. Based on the inspection results and properly installed improvements, we recommend a reduced Performance Letter of Credit in the amount of $411,284.95, which represents the maximum reduction of 25%.

All improvements shall be constructed in accordance with the Town's Development Standards and all applicable Town, County, State and Federal regulations. The Applicant is required to obtain all Town, County, State and Federal permits required for the construction of this project.

Zoning Commitment

This ZONING COMMITMENT (hereinafter, the "Commitment"), is made and entered into this ____ day of ____________, 2026, by Petitioner, Norman Majesky, d/b/a Grand Prize Auto, who appeared personally, and with Counsel, Attorney Roy Dominguez, and with Owner Representative, Rob Henn, of Henn Holdings, LLC (hereinafter, the "Owner"), as a condition of approval for Site Plan Waiver to be issued by the Town of Cedar Lake, Lake County, Indiana, Plan Commission, or any other jurisdictional bodies of the Town of Cedar Lake (hereinafter, the "Town"), of a certain parcel of Real Property located at what is commonly known as 13318-13324 Wicker Avenue, Cedar Lake, Lake County, Indiana, and which is legally described hereinafter in this Commitment.

Witnesseth

WHEREAS, the Town seeks to foster and uniformly regulate land-use of development within the Town for the benefit of the residents of the Town; and

WHEREAS, the Town is informed that the subject parcel of Real Estate which is the subject of this Site Plan Waiver Petition is currently Zoned B-3, General Business; and

WHEREAS, the Town is informed and advised that all parcels which are subject to this Commitment are currently proposed to be used for automobile sales, and related purposes; and

WHEREAS, the Petitioner does not own the subject parcel of Real Estate, but now seeks to develop same as an automobile sales and related business parcel with concurrence of the Owner identified hereinabove; and

WHEREAS, the Petitioner submitted an Application for a Site Plan Waiver to the Town of Cedar Lake Plan Commission, through its Planning and Building Department, on or about June 10, 2026; and

WHEREAS, the Town of Cedar Lake Plan Commission thereafter held a Public Meeting on July 15, 2026, and after hearing the evidence and information of the Petitioner and Owner, as well as the attending public, and following due deliberation, did, in said Public Meeting, by voice vote, approve a Site Plan Waiver for the subject parcel to Petitioner and Owner, as petitioned for, all of which is set forth in the minutes of the Public Meeting referenced, a copy of which is attached hereto as Exhibit "A".

NOW, THEREFORE, in consideration of the foregoing, adequacy and receipt of which is acknowledged, the Petitioner and Owner hereby agree as follows:

SECTION ONE — Commitment: The Petitioner acknowledges and accepts the covenants and terms hereof and agrees to develop and use the subject parcel of Real Estate for the sole purpose of conducting a automobile sales and related business uses as permitted by Right in a B-3 General Business Zoning District, as set forth in the Town Zoning Ordinance No. 1402, and all other consistent with current Zoning Law & Ordinances, as amended from time to time.

Proposal Conditions

  1. Proposal includes 1 mobilization for patching.
  2. No aggregate base is included.
  3. Base Bid does not include sub-base improvements. No import/export of base material is provided for additional material required to remedy sub-base imperfections.
  4. Sub-base proof rolling is excluded.
  5. Proposal is for project as per plan and must be accepted within 30 days of the above date. Additional costs will be billed should the project scope change drastically.
  6. Work to be performed during 2026 construction season.
  7. Labor and material are warranted for ONE year from the date of completion of our work.
  8. Construction engineering and layout are to be provided by OTHER'S.
  9. Bonds and permits are excluded. If required, they will be provided at an ADDITIONAL cost to the Owner.
  10. Traffic Maintenance and Control are to be provided by OTHER'S.
  11. No asphalt material testing is included.
  12. Asphalt milling, sweeping and saw cutting not specified is excluded.
  13. No landscape restoration is included.
  14. Additional asphalt pavement removal and/or patching not specified is excluded.
  15. Proposal is based on a five-day work week. There will be an additional charge for Saturday and/or Holiday hours.

Scheduling: After the proposal is signed and returned, Site Services will make a work order for the operations manager. The Town will then be contacted regarding a proposed schedule for the project. The proposal requests that the Town indicate any issues that will affect scheduling of this project, the hours the facility is open, and any dates of special events. Site Services does not work on Sunday.
